Terms of Service
These Terms of Service, together with any policies they reference (including our Privacy Policy and Subscription Terms), form a binding agreement between you (“you”, “your”) and IQ Brio Limited (“IQBrio”, “we”, “us”, “our”), a company registered at 2450 Mccoy Rd, Bear, Delaware (DE), 19701. They govern your access to and use of https://iqbrio.com and all related features and content (the “Service”).
By accessing or using the Service, you confirm that you have read, understood, and accepted these Terms. If you do not agree with any part of them, please do not use the Service.
1. Important Notice
Auto-renewal. Paid subscriptions are billed automatically at the end of each period and renew on the same terms unless you cancel in advance.
Educational purpose.IQBrio's assessments, scores, and related content are provided for informational and educational purposes only. They are not clinical or diagnostic instruments, and results should not be treated as a certified measure of intelligence or used as the basis for medical, psychological, educational, or employment decisions.
Arbitration notice. These Terms include an arbitration agreement and a waiver of your right to participate in a class action. Please review Section 15 carefully.
2. Changes and Modifications
We may revise these Terms from time to time. The current version is always available on our website, and where the law requires it, we will notify you of material changes. Continuing to use the Service after an update means you accept the revised Terms.
3. The Service
IQBrio offers cognitive and IQ-style assessments, personalized scoring and result summaries, and related educational content, for personal, non-commercial use.
We do not guarantee that results are scientifically validated, comparable to standardized psychometric tests, or fit for any particular purpose. Treat every score as an estimate, not a certified evaluation.
4. Eligibility
You must be at least 18 years old to use the Service on your own. If you are a minor in your jurisdiction, a parent or legal guardian must review and accept these Terms on your behalf before you use IQBrio. We may ask for proof of age if we have reason to doubt it, and may suspend access until it is provided. Consistent with the Children's Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from anyone under 13.
5. Accounts
Some features require an account. You are responsible for providing accurate information, keeping your login credentials confidential, and for all activity that occurs under your account. We may suspend or close accounts at our discretion, including for violations of these Terms.
6. Use of the Service
Use IQBrio only for lawful purposes and in accordance with these Terms. You may not copy, reverse-engineer, or extract any part of the Service; scrape or otherwise harvest data from it; interfere with its infrastructure or security, including through malicious code or unauthorized access attempts; upload unlawful, harmful, or infringing content; or impersonate another person or entity.
We may suspend or terminate your access immediately, without notice, if you breach this section.
7. Subscription and Payments
General. The Service may be sold on a subscription or one-time basis. When you make a purchase, you agree to pay the price and any taxes or fees shown to you at checkout.
Auto-renewal. Paid subscriptions renew automatically for the same length as your original term unless cancelled as described below. By subscribing, you authorize us to charge your chosen payment method each renewal period without seeking approval again. Any trial or promotional offer converts automatically into a full-price subscription once it ends, unless cancelled beforehand.
Checkout. Completing a purchase means you have reviewed and accepted the price, billing frequency, and renewal terms shown at checkout, and you authorize IQBrio and our payment partners to charge you accordingly.
Trials. If a trial is offered, it lasts for the period disclosed at signup and converts into a paid subscription automatically once it ends, unless you cancel first. Keeping track of the trial length and cancelling in time is your responsibility.
Payment processing. Payments are handled by third-party processors. We are not responsible for fees, currency conversion, declines, or other issues caused by your bank or payment provider.
Cancellation. You can cancel at any time from your account settings or by contacting support@iqbrio.com. To avoid the next charge, cancel at least 24 hours before your renewal date. After cancelling, you keep access until the end of the period you already paid for; deleting your account or simply not using the Service does not cancel your subscription automatically.
Refunds. Purchases are generally final, subject to the exceptions described in our Refund Policy and applicable consumer-protection law.
Abuse and chargebacks. We may investigate suspected abuse of the refund or payment-dispute process, including baseless chargebacks, and respond by disputing the claim, suspending or closing the account involved, and limiting future access.
8. Communications
By using the Service you agree to receive service and account-related messages from us, such as login notices, billing receipts, and support replies. If you share contact details for marketing, you may also receive promotional messages where the law allows it.
9. Third-Party Services
IQBrio may link to third-party sites or tools we do not control. Those links are provided for convenience and do not imply endorsement; we are not responsible for their content or practices, and your use of them is at your own risk.
10. Intellectual Property
Everything that makes up the Service — text, design, software, trademarks, and other materials — belongs to IQBrio or its licensors and is protected by intellectual-property law. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose, nothing more. Copying, redistributing, or building derivative works from it without permission is prohibited.
11. User Content
Anything you submit to the Service is licensed to us on a worldwide, royalty-free basis so we can operate, improve, and promote IQBrio. You are not entitled to compensation for this, and you confirm the content is not confidential.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES — EXPRESS, IMPLIED, OR STATUTORY — INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT PROMISE THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY RESULT IT PRODUCES WILL BE ACCURATE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IQBRIO IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, DATA, OR GOODWILL — ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF WHAT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100). YOU USE THE SERVICE AT YOUR OWN RISK, AND WE ARE NOT RESPONSIBLE FOR DAMAGE TO YOUR DEVICE, LOST DATA, OR OTHER HARM RESULTING FROM YOUR ACCESS TO OR USE OF IT.
14. Indemnification
You agree to defend and hold IQBrio and its affiliates harmless from claims, damages, and expenses arising from your use of the Service or your breach of these Terms.
15. Governing Law and Dispute Resolution
These Terms and any dispute arising from them are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Claims not subject to arbitration will be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction.
Except where prohibited by law, any dispute relating to these Terms or the Service will be resolved through binding, individual arbitration rather than in court. By agreeing to arbitrate, you give up the right to a jury trial and to the broader discovery or appeal rights available in litigation, and you agree not to bring or join a class, collective, or representative action. This arbitration agreement covers IQBrio, you, and each of our respective affiliates, officers, employees, and agents; either side may still bring an individual claim in small-claims court where eligible. Where mandatory arbitration is not enforceable in your jurisdiction, this section applies to the extent the law allows.
16. Electronic Communications
You consent to receiving communications from us electronically, and agree that electronic notices, agreements, and disclosures satisfy any legal requirement that they be in writing.
17. Termination
We may suspend or end your access to the Service at any time, with or without cause or notice, including for violating these Terms or applicable law.
18. Miscellaneous
These Terms are the entire agreement between you and IQBrio regarding the Service. If a court finds part of them unenforceable, the rest stays in effect. Not enforcing a right here does not waive it, and we may assign these Terms without restriction.
